Sure, the Apple vs. Samsung trial ended in August, with a verdict that was decidedly in Apple’s favor. But, it’s not all wrapped up between the two parties. Both companies return to a Northern California district court tomorrow for a hearing.
CNET:
On the docket are a number of issues that have been the focus of more than 200 court filings since the late August jury verdict, which left Samsung on the hook for $1.05 billion in damages. That includes whether that amount should be changed, if Apple can get some of Samsung’s infringing devices banned, and if Samsung can vie for a retrial based on what it says was misconduct by the jury foreman.
When they march into the courtroom on Thursday, here’s what’s at stake:
Damages – Apple was awarded $1.05 billion back in August, U.S. District Court Judge Lucy Koh has the power to lower or even increase this tally.
Sales Ban – After the verdict was handed down, Apple filed paperwork to get a sales ban on eight of Samsung’s phones. The phones were older models, but they are still on sale. Newer devices from both companies will be decided on in a separate battle between the two companies, which kicks off in 2014.
Retrial – Samsung could get a do-over. In an October filing, Samsung took issue with Velvin Hogan, the jury foreman in the case. Samsung says Hogan didn’t bring up the fact that he had a legal fight with Seagate in 1993. (Samsung owns part of Seagate.) Samsung says that may have tainted his objectivity.
