A French court has denied Samsung an injunction banning iPhone 4S sales in France, reports FOSS Patents. The ruling also orders Samsung to pay €100,000 in legal fees to Apple, although Apple’s request for damages has been denied.
From FOSS Patents Florian Mueller:
It became clear that the legal standard for a preliminary injunction is reasonably high in France, and Apple’s lawyers made a number of points that I couldn’t verify in their entirety but which appeared strong enough to dissuade the court from ordering a ban.
Apple and Samsung have been engaged in a heated worldwide legal dispute over patent infringement and intellectual property disputes for a number of months, with each company claiming that the other is using their patents without permission or licensing.
