Powerbeats 2 customers have begun receiving payouts from a class-action lawsuit settled last year. The lawsuit claimed that Apple had misrepresented both the battery life and the sweat resistance of the wireless headphones. Owners had claimed that some of the headphones had a defect that could cause them to stop working and fail to retain charge after “minimal usage.”
Plaintiffs claim that as a result of the defect Apple misrepresented the battery life of Powerbeats 2 and that Powerbeats 2 earphones were sweat & water resistant. Plaintiffs also claim that Apple did not properly repair or replace defective Powerbeats 2 within the one-year limited warranty period. The Court has not decided in favor of either party. Instead, both sides have agreed to the Settlement. Apple denies all allegations and is entering into this Settlement to avoid burdensome and costly litigation. The Settlement is not an admission of wrongdoing.
As is usual for settlements of this type, Apple agreed to pay out $9.75 million without admitting that it did anything wrong.
The settlement was approved in January 2021 and the money from Apple is being split between Attorneys and Class Members that submitted claim forms. Powerbeats 2 earbuds owners that had purchased their headphones before August 2, 2020 were eligible to claim a payment from the settlement.
