The San Jose Mercury News reports Samsung is asking the U.S. Federal Court of Appeals to reconsider part of their recent ruling that would lead to Apple receiving $548 million in damages in their patent damages suit agains the Korean firm.
The Korean company wants the court to hear the case with its full 12-judge roster rather than the 3-judge panel it used in the previous ruling.
Samsung lawyers argued:
“Unlike rugs, spoons, and simple mechanical objects, smartphones incorporate hundreds or thousands of different patented technologies, and it is undisputed here that Apple’s design patents claim only partial, minor features of such devices.”
A jury ruled in 2012 that Samsung had willfully infringed on a number of Apple patents, awarding the Cupertino firm damages in the amount of $1 billion. The award was reduced to around $900 million a short time later, due to a finding that the jury erred in its decision. A significant part of the judgement was reversed earlier this year, lowering the award further to $548 million. Samsung’s latest filing looks to reduce that judgment further, in an attempt to throw out $400 million of the damages the Korean firm owes Apple.
Samsung’s latest filing is just another move in a long-running legal chess match between the two companies. The legal battle has been fought in a number of courts, in numerous countries around the world.
