Apple filed a motion with the U.S. Court of Appeals for the Federal Circuit in California yesterday, to officially end its pursuit of a product sales ban against older Samsung devices. This officially drops the company’s cross-appeal of Judge Lucy Koh’s final judgement in its 2012 lawsuit against Samsung.
iDownloadBlog notes that while Apple had been looking for a permanent injunction against all of Samsung’s infringing devices in that case, it appears to have given up on the battle where older devices are concerned.
The devices in question are generations-old, and are no longer sold, so Apple likely decided to focus its considerable legal energies on pursuing a permanent injunction on the newer devices covered in the second Samsung trial.
While Samsung naturally agreed with Apple’s motion to dismiss, it is continuing its own efforts to have Judge Koh’s final ruling dismissed completely.
