Apple v. Samsung Damages Retrial is Underway

The jury trial to determine just how much Samsung does owe Apple for damages for patent infringement is underway in the US District Court for the Northern District of California in San Jose, Calif.

Recall that a jury initially awarded Apple US$1.05 billion in damages back in August of 2012 after finding that an array of Samsung smartphones infringed upon Apple design and utility patents.

In the followup proceedings to that trial, it came to light that the jury may have made some errors in determining the damages owed to Apple, therefore Judge Lucy Koh determined that $450 million of the $1.05 billion judgment needed to be recalculated. The retrial on that matter began yesterday, and is scheduled to last for six days.

Many of the devices found to be infringing during the 2012 trial are no longer sold in the U.S., so this week’s decision will have little effect on the average consumer. The proceedings are merely being held to come up with a final total on how big a check Samsung will be writing to Apple.
