To be filed under: “Believe it or Not!” After around 50 hours of testimony, hundreds of pieces of evidence, and who knows how much spending on expensive hired-gun experts, both sides have rested their case in the mega-patent Apple vs. Samsung trial. Exhale.
“We are done,” Judge Lucy Koh said as Apple lawyer Bill Lee ended his cross-examination of Samsung’s last rebuttal witness.
Testimony ended with a rapid-fire succession of witnesses as both Apple and Samsung raced against the clock. Koh limited each side to 25 hours of testimony before the jury.
The two sides still have to finalize the instructions that will be sent to the jury, made up of seven men and two women. Each side will be allowed to deliver two hours of closing arguments on Tuesday before the jury starts its deliberation.
Apple is suing Samsung for violating several patents and for “trade dress”, which is infringing on protected design elements. Samsung denies those charges, and has fired back with its own suits for infringing on three feature patents as well as some core wireless patents.
It will be necessary for the jury to agree unanimously that a particular patent is both valid and infringed in order to make a finding for infringement. Dozens of different devices are at issue in the case, as well as the numerous patents.
Judge Koh has suggested to both sides that they should narrow their case against each other, even suggesting some tit-for-tat type trading.
