“Beat Apple” Files May Prove to be the Smoking Gun in Apple Vs. Samsung Case

The testimony of Apple’s final witness for Friday, Samsung’s chief strategy officer Justin Denison, gave the jury the first look at what could prove to be the “smoking gun” in the trial, Samsung’s “Beat Apple” files.

CNN Money:

Asked under oath whether Samsung tried to emulate any Apple products, Denison, according to CNET‘s reporting, said that was not the case.

His testimony gave Apple’s lawyers the opening to start introducing a series of internal Samsung documents, with title such as:

“Beat Apple response”
“Lessons from Apple”
“Why you should care about Apple”
“Recent Apple analysis project”
“iPhone 5 counter strategy”

The jury was shown the Samsung-created slides which displayed side-by-side comparisons of iPhones and Samsung phones still under development. Specific “directions for improvement” were listed on the slides.

The “improvements” often included instructions to “borrow” design elements from Apple, such as double tapping to zoom into a portion of a screen, or adding three-dimensional lighting effects on icons to give them a “luxurious feel” like those on the iPhone.

In one slide, Samsung’s designers were advised to get rid of the “strong impression that iPhone’s icon concept was copied.”

The trial resumes on Monday with more testimony for Apple’s side.
