In mid October, Apple won an injunction banning Samsung from selling their Galaxy Tab 10.1 in Australia. Despite the fact that the injunction only applies to Samsung, Apple began issuing letters to retailers notifying them of the injunction, and asking them to stop selling the device.
The Sydney Morning Herald reports that one Australian retailer, dMavo, is standing up to Apple, and continues to sell the device despite Apple’s request, stating on their website that they “will not bow down to Apple.”
Apple has yet to formally take action about this, but considering that they’ve already won the injunction, it likely wouldn’t take much for Apple to target individual retailers through the court system, and legally ban sales at all retailers who refuse to comply with their request.
The notice has since been removed from dMavo’s Galaxy Tab 10.1 order page, but the retailer still appears to be selling the devices in Australia, despite receiving a notice from Apple. dMavo managing director Wojtek Czarnocki had this to say:
We have a new entity established and a separate server – just to deal with the tablet orders – that is undergoing testing as of last Saturday. Was Apple just bluffing or do they really want to play the cat and mouse game? We’re up for it.
This retailer is clearly very unwilling to back down – it will be interesting to see whether Apple simply shrugs, or if they decide to take some type of action.
