The exhausting legal battle between Apple and Samsung has just taken another significant concern, reports The Verge, as U.S. District Judge Lucy Koh denied Apple’s request for a preliminary junction banning sales of Samsung’s Galaxy phones and tablets.
There have been wins on both sides in this ongoing battle, with most of those wins having been in Apple’s favor. Koh felt that Apple had a case against Samsung, but did not feel that any of Samsung’s likely violations would cause lasting harm to Apple.
What’s also interesting is that Judge Koh notes that Apple is likely to succeed in proving that Samsung is violating their patents, but since the violations won’t cause irreparable harm, Samsung will only have to pay damages on the infringing products sold, and won’t have to pull their devices from shelves.
